Terms of Service

Welcome to 24Crush! These Terms of Service ("Terms") govern your use of the 24Crush mobile application ("App") operated by Crushsoft (크러쉬소프트, "Company," "we," "us," or "our"). By creating an account or using the App, you agree to be bound by these Terms.

1. Eligibility

  • You must be at least 18 years old to create an account and use 24Crush.
  • By creating an account, you represent and warrant that you are at least 18 years of age.
  • You must be legally able to enter into a binding contract.
  • You must not be prohibited from using the App under any applicable law.
  • You may only maintain one account at any time.

2. Account Creation and Security

  • You may create an account using Apple Sign-In, Google Sign-In, Facebook Login, or email/password registration.
  • You are responsible for maintaining the confidentiality of your login credentials.
  • You are responsible for all activity that occurs under your account.
  • You agree to provide accurate, current, and complete information during registration and to keep your profile information up to date.
  • You must not impersonate any person or misrepresent your identity, age, or affiliation.

3. Services Provided

24Crush provides the following features:

  • Profile Creation: Upload photos and provide personal information to create a dating profile.
  • Swiping & Matching: Browse other user profiles, express interest (Like) or pass, and connect with mutual matches.
  • Blind Matching: Be randomly paired with another user for a 24-hour anonymous chat experience, after which profiles are revealed.
  • Chat: Send and receive messages with matched users.
  • Photo Verification: Optionally verify your identity through a liveness check and facial comparison.
  • Premium Subscription: Access advanced features such as unlimited likes, advanced filters, see who liked you, and blind match re-requests.

4. User Content

A. Ownership

You retain ownership of all content you submit to the App, including photos, bio text, and chat messages ("User Content").

B. License Grant

By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free, transferable license to use, display, reproduce, and distribute your User Content solely for the purpose of operating and providing the App's services. This license terminates when you delete your content or account, except where your content has been shared with other users (e.g., chat messages sent).

C. Responsibility

You are solely responsible for your User Content. You represent that:

  • You own or have the necessary rights to your User Content.
  • Your User Content does not violate any third party's rights.
  • Your User Content complies with these Terms and our Community Guidelines.

D. Content Removal

We reserve the right to remove any User Content that violates these Terms without prior notice.

5. Prohibited Conduct

You agree NOT to:

  1. Misrepresent your identity, age, or use someone else's photos.
  2. Harass, stalk, bully, or threaten other users.
  3. Send unsolicited sexual content, explicit images, or offensive material.
  4. Engage in spam, solicitation, or commercial activity through the App.
  5. Post content that is illegal, hateful, discriminatory, defamatory, or violent.
  6. Attempt to collect other users' personal information for any purpose.
  7. Use the App for any illegal purpose or in violation of any applicable laws.
  8. Create multiple accounts or use the App after being banned.
  9. Interfere with or disrupt the App's functionality, servers, or networks.
  10. Reverse engineer, decompile, or modify the App.
  11. Use bots, scripts, or automated methods to access the App.
  12. Promote or facilitate prostitution, escort services, or human trafficking.

Violation of these rules may result in warnings, temporary suspension, or permanent ban at our sole discretion.

6. Reporting and Moderation

  • You may report any user who violates these Terms by using the in-app report feature.
  • We review all reports and take appropriate action, which may include warnings, suspensions, or bans.
  • We may access chat history in connection with report investigations for safety purposes.
  • Decisions regarding account actions are at our sole discretion.

7. Premium Subscription and Payments

A. Subscription

  • 24Crush offers optional premium subscriptions ("24Crush Premium") with enhanced features.
  • Subscriptions are billed through Apple In-App Purchases and are subject to Apple's terms and conditions.
  • We do not directly collect or store your payment method (credit card, etc.). All payment processing is handled by Apple.

B. Auto-Renewal

  • Subscriptions automatically renew at the end of each billing period unless you cancel.
  • You can manage or cancel your subscription through your Apple ID settings (Settings > Apple ID > Subscriptions).

C. Refunds

  • Refund requests must be submitted directly to Apple, as Apple processes all payments.
  • We do not issue refunds directly.

D. Price Changes

We may change subscription pricing at any time. Price changes will be communicated in advance, and you will have the option to cancel before the new price takes effect.

8. Photo Verification

  • Photo verification uses facial recognition technology to compare a live selfie with your profile photos.
  • Verification is optional but may be required for certain features.
  • Verification selfies are deleted immediately after processing and are not stored permanently.
  • A verified badge does not guarantee a user's intentions, character, or safety.

9. Location Services

  • 24Crush uses your device's GPS to provide distance-based matching and display your approximate location (city/state) on your profile.
  • Your exact coordinates are never shared with other users; only approximate distance is displayed.
  • You may disable location services at any time through your device settings, but this may limit the App's functionality.

10. Account Deletion

  • You may delete your account at any time through the App (Profile > Settings > Delete Account).
  • Upon deletion:
    • Your profile will be immediately hidden from other users.
    • Your data will be retained for a 30-day recovery period, after which it will be permanently deleted.
    • Certain data may be retained for legal compliance (e.g., subscription records, moderation records).
  • You may also request account deletion by contacting us at crushai.team@gmail.com.

11. Disclaimers

  • THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
  • WE DO NOT GUARANTEE THE ACCURACY OF INFORMATION PROVIDED BY OTHER USERS.
  • WE DO NOT CONDUCT CRIMINAL BACKGROUND CHECKS ON USERS.
  • WE ARE NOT RESPONSIBLE FOR THE CONDUCT OF ANY USER, WHETHER ON OR OFF THE APP.
  • WE DO NOT GUARANTEE MATCHES, DATES, OR ANY SPECIFIC OUTCOMES FROM USING THE APP.
  • USE THE APP AT YOUR OWN RISK. ALWAYS EXERCISE CAUTION WHEN MEETING SOMEONE IN PERSON.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to indemnify, defend, and hold harmless the Company, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorney's fees) arising from your use of the App, your User Content, or your violation of these Terms.

14. Dispute Resolution

A. Governing Law

These Terms shall be governed by the laws of the State of California, without regard to conflict of law provisions.

B. Arbitration

Any dispute arising from these Terms or your use of the App shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration shall be conducted in San Francisco, California.

C. Class Action Waiver

YOU AGREE THAT ANY DISPUTE RESOLUTION SHALL BE CONDUCTED ON AN INDIVIDUAL BASIS AND NOT AS A CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE ACTION.

D. Exceptions

Either party may bring an individual action in small claims court for disputes within that court's jurisdiction.

15. Modifications

We may update these Terms from time to time. Material changes will be communicated through the App. Your continued use of the App after changes are posted constitutes acceptance of the updated Terms.
